The following Terms cover matters relating to our intellectual property and information that you provide to Take My Car.
At Take My Car, we collect and manage user data according to the following Privacy Policy, with the goal of incorporating our company values: transparency, accessibility, sanity, usability. This document is part of Take My Car's Terms of Service, and by using Take My Car services you agree to the terms of this Privacy Policy and the Terms of Service. Please read the Terms of Service in their entirety, and refer to those for definitions and contacts.
1. Content and Content Rights
For purposes of these Terms: (i) “Content” means text, graphics, images, music, software, audio, video, works of authorship of any kind, and information or other materials that are posted, generated, provided or otherwise made available through the Services; and (ii) “User Content” means any Content that Members provide to be made available through the Services. Content includes without limitation User Content.
1.1 Content Ownership, Responsibility and Removal
Take My Car does not claim any ownership rights in any User Content that you make available through the Services and nothing in these Terms will be deemed to restrict any rights that you may have to use and exploit your User Content. Subject to the foregoing, Take My Car and its licensors exclusively own all right, title and interest in and to the Services and Content, including all associated intellectual property rights. You acknowledge that the Services and Content are protected by copyright, trademark, and other laws of the United States and foreign countries.
You agree not to remove, alter or obscure any copyright, trademark, service mark or other proprietary rights notices incorporated in or accompanying the Services.
1.2 Rights in User Content Granted by You
By making any User Content available through the Services, you hereby grant to Take My Car a non-exclusive, transferable, sublicense able, worldwide, royalty-free license to use, copy, modify, create derivative works based upon, publicly display, publicly perform and distribute your User Content in connection with operating and providing the Services and Content to you and to other Members and Agents.
You are solely responsible for all your User Content. You represent and warrant that you own all your User Content or you have all rights that are necessary to grant us the license rights in your User Content under these Terms. You also represent and warrant that neither your User Content, nor your use and provision of your User Content to be made available through the Services, nor any use of your User Content by Take My Car, Agents or Members on or through the Services will infringe, misappropriate or violate a third party’s intellectual property rights, or rights of publicity or privacy, or result in the violation of any applicable law or regulation.
You can remove your User Content by specifically deleting it. However, in certain instances, some of your User Content may not be completely removed and copies of your User Content may continue to exist on the Services. We are not responsible or liable for the removal or deletion of (or the failure to remove or delete) any of your User Content.
1.3 Rights in Content Granted by Take My Car
Subject to your compliance with these Terms, Take My Car grants you a limited, non-exclusive, non-transferable, non-sublicense able license to access and view the Content solely in connection with your permitted use of the Services.
2. Sharing of Data
We don't share your personal information with third parties. Only aggregated, anonymized data is periodically transmitted to external services to help us improve the Take My Car service. We currently use Google Analytics (traffic analysis), Facebook Analytics (traffic analysis), Amplitude (analytics). We listed below what data these third parties extract exactly. Feel free to check out their own Privacy Policies to find out more.
Google Analytics: anonymous (ad serving domains, browser type, demographics, language settings, page views, time/date), pseudonymous (IP address).
Facebook Analytics: anonymous (ad serving domains, demographics, language settings, time/date), pseudonymous (IP address).
Amplitude: anonymous, pseudonymous.
We also use social buttons provided by services like Twitter and Facebook. Your use of these third party services is entirely optional. We are not responsible for the privacy policies and/or practices of these third party services, and you are responsible for reading and understanding those third party services privacy policies.
We may choose to buy or sell assets. In these types of transactions, user information is typically one of the transferred business assets. Moreover, if we, or substantially all of our assets, were acquired, or if we go out of business or enter bankruptcy, user information would be one of the assets that is transferred or acquired by a third party. You acknowledge that such transfers may occur, and that any acquirer of us or our assets may continue to use your personal information as set forth in this policy.
3. Changes to the Privacy Policy
We may amend this Privacy Policy from time to time. Use of information we collect now is subject to the Privacy Policy in effect at the time such information is used. If we make major changes in the way we collect or use information, we will notify you by posting an announcement on the website. A user is bound by any changes to the Privacy Policy when he or she uses the Services after such changes have been first posted.
